Following the Council’s decision to approve a bulky student accommodation block on the Cricket Club site, against the advice (in that form) of their officers and Historic England, and following the Secretary of State’s advice NOT to call the application in, BPT is considering putting forward a case for judicial review. Preliminary legal advice suggests it is worth going at least to the next stage. The first formal stage may cost around £5000 and further stages, though costs may well be capped, will cost more. The Council has recently lost two judicial review cases and we believe that this case demonstrates again the need for better planning decisions and that B&NES are vulnerable to such review. HOWEVER, IN ORDER TO PURSUE THIS BPT NEEDS TO KNOW WHETHER WE HAVE SOME FINANCIAL PLEDGES FOR SUPPORT.
